USA Access exercises no control over the content of the information passing through the Internet. USA Access makes no warranties of any kind, whether expressed or implied, for the service it is providing. USA Access also disclaims any warranty of merchantability or fitness for a specific purpose. USA Access will not be responsible for any damage you suffer. This includes loss of data resulting from delays, service interruptions, or non deliveries caused by its own negligence or our errors or omissions. Use of any information obtained via Internet is at your own risk.

Internet may only be used for lawful purposes. Transmission of any material in violation of any US or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to hold harmless USA Access from any claims resulting from your use of the service which damages you or another party.

Restricted Content
Pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited. Sites that contain materials that are not in compliance with acceptable community standards are prohibited and subject to account termination. Examples of non-acceptable content or links include:
  • Pirated software
  • Hackers programs or archives
  • Warez Sites
  • Gore or death
  • Illegal download sites.

USA Access will be the sole arbiter as to what constitutes a violation of this provision.

Equal Access
No content that may be considered prejudicial or abrasive to a individuals Race, Creed or Color.

Legal Content
No business of an illegal nature may be transacted on USA Access servers.

Domain Names and IP Numbers
Only 1 domain name can be registered per account. Each domain name must be accompanied by an existing USA Access account and contain a unique IP number. All IP numbers will be assigned by USA Access.

IP and DNS Entries
All IP and DNS entries must be made by USA Access staff. No outside individual or company can point other unauthorized domain names or DNS entries to our equipment.

Spamming & Other e-mail issues
We do not allow misuse of mailing lists. This includes sending any unsolicited E-mail or mail that’s deemed as spammed. Lists are designed as a invaluable business tool, and should be used as such. USA Access does not tolerate spamming of USENET newsgroups. If we are contacted regarding abuse of your USA Access mail account, it will be terminated while we investigate. If it’s determined that the account was used to spam individuals or newsgroups, we will terminate your entire account without notice. You will still be responsible for the current invoice.

Server Protection
Any attempts to undermine or cause harm to a USA Access server or customer of USA Access is strictly prohibited.

General Site Use
We are pleased to offer our clients generous allotments of GBs per month of Web page traffic, to maintain the integrity of our service the following limitations apply.

  • Sites housing multiple directories with unrelated information. (Feel free to contact us regarding a dedicated server.)
  • Sites with more than one main page.
  • Multiple hosts resolving at a ip or domain name we provide.
  • Sites offering download archives, such as .zip, .tar, .ra and .gz.
  • Sites using more than 20% of system resources.

Traffic Restrictions
If you do not qualify for unlimited, traffic will go unmonitored until you reach the specified gigs, then normal data transfer costs of $50.00/gig will apply. USA Access will be the sole arbiter as to what constitutes a violation of this provision.

Manual and Related Support Issues
We are proud to offer complete online documentation which covers the proper installation and execution of the features loaded on your site. This on-line manual is a great place to begin when executing advanced server applications.

  1. We do not teach HTML or programming.
  2. Our support is limited to issues concerning either the pre-installed features, or the actual operation of the servers. We will guarantee that all pre-configured loaded scripts are operational at the time of account activation. Our support does not include editing or assembling HTML and code. Basic computer and internet knowledge is required to implement many of the site features.
  3. USA Access understands that most clients change their domain name password. We do not as a general rule follow up on these changes. If the need arises to enter your site and make corrections or modifications, we may reset your password to the original default.

USA Access Billing Department Policies:

  • USA Access can only establish a new account upon receipt of a Visa or MasterCard number, or payment in advance.
  • Service is paid monthly via a major credit card, or yearly when paid in advance.
  • Payment is "on receipt" of bill. Accounts are in default if payment is not received within 10 days. If payment is not collected by this date your account will be subject to interruption. Your material online may be lost due to your account interruption, Therefore you are responsible for keeping a backup of your site.
  • USA Access will bill for credit cards for services provided annually based on the terms of the package agreement designated by the account owner. In the event of a cancellation or account transfer to another hosting company: If an account owner fails to notify USA Access of cancellation or transfer the amount billed within’ the designated hosting agreement is non-refundable.
  • USA Access requires 30-days cancellation notice on all hosting accounts utilizing hosting services beyond the first 30-day period.
  • Returned checks are subject to a $50 service charge.

  • All notifications via the US Mail must be postmarked within’ 30-days of the site activation.
  • Phone calls are accepted with regards to cancellation, however the telephone notice must be followed up in writing to be in compliance with the terms of the agreement.
  • All e-mail notifications must be received within’ 30-days of the site activation.

Acceptance of the Terms Outlined.
These Terms and Conditions supersede all previous representations, agreements or understandings and shall prevail regardless of any variance with terms and conditions of any order submitted. Use of USA Access Internet services constitutes acceptance of these Terms and Conditions.
